These Terms of Use (“Terms”) govern your access to and use of the MyMedPath application (the “Service”), operated by MyMedPath, LLC (“we,” “our,” or “us”). By accessing or using the Service through our secure website login, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Eligibility and Account Registration

  • You must be at least 18 years old and authorized by your organization to use the Service.
  • To access the Service, you must create an account and provide accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2. Scope of the Service

  • MyMedPath provides a secure, cloud-based platform for Dental Practice licensure compliance management, including AI-powered document intelligence, automated tracking, reminders, dashboards, reporting, and integrations.
  • We may update, enhance, or modify features of the Service at any time. We will provide reasonable notice if changes materially impact functionality.

3. User Responsibilities

  • You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and licensing requirements.
  • You are responsible for the accuracy, completeness, and legality of any data, documents, or content you upload into the Service.

You must not:

  • Share login credentials outside your organization.
  • Attempt to gain unauthorized access to the Service.
  • Copy, reverse engineer, or exploit any part of the Service for competitive purposes.

4. Data Security and Privacy

  • We implement industry-standard safeguards to protect your data.
  • Your use of the Service is also governed by our Privacy Policy, available here.
  • You retain ownership of documents and data you upload. By uploading, you grant us a limited license to process and store such data solely to provide the Service.

5. Subscription, Fees, and Payment

  • Access to the Service is provided on a subscription basis as agreed in your organization's order form or subscription agreement.
  • All fees are non-refundable except as expressly stated in writing.
  • We may suspend or terminate your access if payment obligations are not met.

6. Compliance and Audit Readiness

  • The Service provides tools to help you track compliance. However, your organization remains solely responsible for meeting all regulatory and licensure requirements.
  • We do not guarantee compliance or legal outcomes. Audit-ready reports are provided as informational tools only.

7. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access immediately if you violate these Terms, misuse the Service, or cause security or compliance risks.
  • Upon termination, your right to access the Service ends, but we will make reasonable efforts to allow you to export your data.

8. Intellectual Property

  • All rights, title, and interest in the Service, including underlying software, AI models, and design, remain our exclusive property.
  • You may not use our trademarks, branding, or content without prior written permission.

9. Disclaimers and Limitation of Liability

  • The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant uninterrupted, error-free, or fully secure operation of the Service.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or compliance outcomes.

10. Indemnification

You agree to indemnify and hold harmless MyMedPath, LLC, its officers, employees, and affiliates from any claims, liabilities, damages, or expenses arising from:

  • Your use or misuse of the Service,
  • Your uploaded data or documents, or
  • Your violation of these Terms or applicable laws.

11. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the United States and the state of Massachusetts.
  • Any disputes will be resolved through binding arbitration or in the state/federal courts of Massachusetts, unless otherwise required by law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on our website or through the Service. Continued use after changes indicates acceptance.
